Agreeing to these terms
These terms cover your use of the Atwater Epoxy Floors and Concrete website and any estimate, scheduling or work you arrange with us. By using this site or booking a job with us, you agree to them. If you don't agree, please don't use the site.
When we do work for you, we'll put the job in a written contract. If that contract says something different from this page, the contract controls that job.
What we do
Atwater Epoxy Floors and Concrete is a flooring contractor in the City of Atwater, CA. We install epoxy, polyaspartic and other floor coatings. We polish, stain, grind, seal and resurface concrete, and we work in nearby cities as well. You can see the full list of services from our home page, and you can read more about the business on our About page.
The information on this site is general. Every slab is different, so nothing here is a quote, a promise of a result or advice for your particular floor until we've seen it in person. Photos show past work and how a finish can look. Your floor may look different because concrete, color and lighting vary.
Estimates and pricing
We give free quotes on site, with no obligation. We base an estimate on what we can see and measure, including the square footage, the condition of the concrete, any old coating that has to come off and the system you pick.
Some problems only show up once the floor is open, such as moisture coming up through the slab, hidden cracks or old sealers under the surface. If we find something that changes the work or the price, we'll stop and explain it to you before we go ahead. We won't do the added work until you approve the change in writing.
An estimate is good for the period written on it. After that, material costs and our schedule may have changed, so we may need to update it.
Your part in the job
We need clear access to the work area, a working power source and water where the job calls for them. The space should be cleared of vehicles, furniture and stored items unless we've agreed in writing to move them. Tell us before we start about anything we can't see, like radiant heat lines, drains or past water problems, so we can plan around it.
Coatings and sealers need time to cure. We'll tell you when you can walk on the floor, when you can put furniture back and when you can drive on it. Keep people, pets and vehicles off it until then, because early use is one of the most common reasons a new floor fails.
Scheduling and cancellation
We'll give you a start date and an estimated length for the job. Temperature, humidity, rain and slab moisture all affect how coatings bond and cure, so we may move a date when conditions aren't right. We'll let you know as soon as we can and set a new date with you.
If you need to reschedule or cancel, call us or reach us through our Contact page as early as possible. Your written contract explains any cancellation rights you have under California law and any charges for materials we've already ordered or work we've already done.
Payment
Your payment terms, including any deposit and when the balance is due, are set out in your written contract. Any deposit stays within what California law allows for home improvement work.
Unless the contract says otherwise, the balance is due when the work is complete. If a payment is late, we may pause any remaining work until the account is current.
Our guarantee and what it doesn't cover
Our work is backed by our satisfaction guarantee. If something isn't right, tell us and we'll come back and look at it. Any written warranty for your job, including what it covers and for how long, is the one in your contract.
No guarantee covers normal wear, damage from misuse, impacts, dropped tools, harsh chemicals or hot tires on systems not rated for them. It also doesn't cover problems that come from the slab itself, such as moisture coming up from below, settling, or cracks that keep moving after we finish. Concrete varies in color and texture from one pour to the next, and that natural variation isn't a defect.
Except for the guarantee and any written warranty we give you, and as far as the law allows, we provide our work and this website without any other warranties, express or implied.
Limits on our liability
As far as the law allows, Atwater Epoxy Floors and Concrete isn't responsible for indirect, incidental or consequential losses, such as lost use of a space or lost business, that come from our work or from using this site. Our total responsibility for any claim about a job is limited to the amount you paid us for that job.
We're licensed and insured. Nothing on this page limits any right you have under California law that can't be waived.
If we disagree
Call us first. Most problems get settled quickly once we're both looking at the floor together. If that doesn't settle it, send us the details in writing through our Contact page, and we'll respond and try in good faith to reach an answer with you.
If we still can't agree, either of us may ask for mediation before going to court. Any lawsuit will be brought in the courts of Merced County, California, and either of us may use small claims court when the claim qualifies.
California law applies
These terms and any work we do for you are governed by the laws of the State of California, without regard to its rules about choosing another state's law.
Changes to these terms
We may update these terms from time to time, and we'll post the new version on this page. The version posted when you use the site applies to that use. A signed contract keeps the terms that applied when you signed it.
